Refund Policy Terms
"MSL Learning Systems Private Limited "(herein referred to as “MSL” and/or “Company”) is a company incorporated under the Indian Companies Act, 1956.
MSL is an education technology services provider, working in collaboration with various Universities of India (i.e Universities recognized as per the University Grants Commission (UGC) Act, 1956.), assisting and providing essential services in the conduct of their academic and professional education programs, that lead to the award of certain Diplomas and Degrees (hereafter referred to as “Certification” or “Certificate”), upon a successful completion by the enrolled candidates.
MSL is by itself NOT a University and is not to mean or be interpreted as a University under any applicable Indian laws and / or University Grants Commission (UGC) Act, 1956.
MSL's clients, i.e. the University in question, may require prospective or enrolled candidates to make certain fee payments as due to the University or Institution via Payment Gateway(s) provided via MSL or its associated payment gateway at https://feepay.msllearning.com .
Refund Policy
All payments made via these site(s) are governed by the Refund Rules and Rules of Enrolment & Withdrawal, as mandated by the Parent Institution itself, and as declared on the University's / Institutes Websites. In case there is no Refund Policy explicitly communicated by the University to the student / candidate, the Fee Policy as mandated by the University Grants Commission, and detailed at the UGC Website - Fee-Refund-Notification shall be considered binding on the student / candidate.
Dispute Resolution and Arbitration
MSL may elect to resolve any controversy or claim arising out of or relating to these Terms or our web-sites or web services by binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996.
Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party.
The arbitration shall be conducted in New Delhi, India and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you or we may seek any interim or preliminary relief from a court of competent jurisdiction in New Delhi, India, necessary to protect the rights or the property of you or MSL (or its agents, suppliers, and subcontractors), pending the completion of arbitration.
The language of Arbitration shall be English.
Governing Laws and Courts
Subject to Arbitration, the parties irrevocably agree and undertake that any controversy or claim arising out of or relating to these Terms or our web-sites and or web services shall be adjudicated exclusively before a competent court in New Delhi, India only. The terms and our web-sites shall be governed by the laws of India.
These Terms, including all terms, conditions, and policies that are incorporated into these terms by reference, constitute the entire agreement between you and MSL, and govern your use of our web-sites , online services, teaching programs and curriculum, superseding any prior agreements that you may have with us.
